This Is Why You're Fat. ? Oatmeal after Spinning

Just a warning? this is very text heavy. I could ramble on forever about this subject.

I was reading Jen?s blog last week and noticed that she mentioned something very familiar to me: this book.

What she wrote in her post is pretty much exactly how I feel about it. I bought it about two years ago- immediately read it cover to cover, and was super-inspired to start Jackie?s program. And I kept up with it- for about a week. I don?t know why, but my motivation tapered off. I also think that I was a little too liberal with the ?cheat meals,? but I?ll elaborate on that later.

After work last Friday, I enjoyed doing my favorite Friday afternoon activities: a good workout, followed by a snack and a nice soak in the tub. Sometimes I read when I?m in the tub, sometimes I just zone out. On that particular day, I grabbed Jackie?s book and started reading it again. As I read, my mind started buzzing. Everything was very familiar and the same ideas were rushing through my head. It?s one of those books that you read and thinkthat makes so much sense? So much of what Jackie writes really makes me take a hard, cold, honest look at my issues with food and why I have so much trouble losing weight.

First and foremost (and I don?t want to just use this as an excuse)- as I?ve stated before- my genetics kind of suck. I have a naturally slow metabolism. I know this because I?ve had metabolic testing done, and mine is in the extremely low range. My resting metabolic rate burns about 500 calories less than it should for someone my height/weight. I?ve also damaged my metabolism due to extreme diet efforts in the past (exercising too much/not eating enough). I just had my thyroid tested again and the results were ?normal.? My cortisol levels were extremely high all throughout the day (they?re tested at 4 different times during the day), so that has a lot to do with my whacked-out hormones. I also do not produce progesterone ? which Jackie calls the ?slim and trim hormone?- which is why I don?t get a period anymore (well, I take birth control which forces a period)- which is again the result of crazy dieting in the past. (I?m really hoping that this balances out soon ? especially when it comes time for baby makin?!)

I don?t want to just make excuses. Yes, I have all of these biological factors making it extremely hard for me to lose weight, but some of the other things that I am choosing to do- that I do have control over- are completely sabotaging all healthy eating and exercise that is the core of my daily life.

Jackie talks about the importance of where your calories come from and how they are broken down in your body and affect your hormones. I definitely have issues with my hormones and notice how much my mood can change when I?m eating better (and when I feel better about my body in general). Chapter 2 of the book is called ?You Are a Sugar Addict.?

Oh really? Am I? Yes?

Just because I don?t eat many processed sugars or junk food- that doesn?t mean that I don?t have a sweet tooth. I make a lot of healthy desserts and make smoothies loaded with fruit- but all of those contain some form of sugar, whether it?s in the form of fructose, lactose, sucrose- whatever- I get cravings for it. One of the ?ah-ha? moments I had when reading this chapter (and the one that follows) was in regards to afternoon/evening eating and the balance of carbohydrates. I always feel the need to have something sweet after dinner- always. I feel almost uneasy if I don?t. I generally set about 200 calories aside just do I can indulge in a (generally healthy) dessert, which is usually heavier in carbs than any other nutrients. I?m starting to think that eating those carbs at night are really messing with my sleep (I always feel tired). (On Monday, for example- I was still feeling hungry after dinner, so I ate a cup of cereal with almond milk and a few pieces of dark chocolate. Afterwards I felt overly full and a little disappointed in myself. And I slept like crap- but that might also be because I had to stay up to watch the Bachelor?) Jackie states that the Human Growth Hormone (HGH) is produced primarily when you sleep. When your blood sugar is low, your body pumps out more HGH. If you ingest more carbs in the evening, your blood sugar spikes, and the production of HGH is halted- and your quality of sleep is lessened severely. A ha!

We all know that I?ve got the exercise thing down. I love to exercise (without overdoing it anymore), etc? yadda, yadda. Portion control (and not overdoing it on evenings or weekends) has always been my biggest battle.

Jackie?s eating plan is extremely do-able. Basically, you eat 3 larger meals (around 400 calories each) and two snacks (around 150 calories). Limit fruit to two servings a day (eek!) and only have carbohydrates in the form of whole grains with two of those meals (for example- oatmeal with breakfast and bread with lunch or brown rice with dinner). Eat enough protein and vegetables (check!) and drink lots of water (definitely got it!). No dessert or alcohol. Drink a cup of tea that is a combination of one bag of (decaf) green tea, and one of herbal tea. (When I did this plan before I always combined a bag of Celestial Seasoning Mandarin Orange tea with green tea. SO GOOD.)

The only issue I have with her eating plan is that she stresses a lot of animal protein more than anything, and I definitely prefer to get mine in the form of plants (legumes, tofu, tempeh, etc) more than anything. I will add a few more animal proteins into my diet, but will also continue to get it in the form of plants often.

On the weekend, you can enjoy two ?treat meals.? This is time when you can have a drink, a dessert, whatever. Your treat meals can only occur after 5 days in a row of clean eating and should not exceed 1,500 calories (it is really easy to rack up that many calories if you eat out at a restaurant and have a drink and/or dessert!) And that treat meal is a meal. Not a day.

When I tried this plan before, I think that I felt like I should indulge on those treat meals over the weekend, even if I didn?t really feel like it. I feel so much better physically when I eat better- and shouldn?t eat crap just because I?m ?allowed? to. I think that this time around, my ?treat? meals will just include a drink of my choice and/or something sweet (like fro-yo) along with my regular healthy foods. Or, another way of looking at it is that I can enjoy a meal out without thinking so much about the calories and just make generally ?good? choices overall. I don?t like fried foods or super rich stuff, so that?s not really the issue. But, I do enjoy a good beer or yummy dessert. :)

Right now I?m inspired. I?m motivated. And I really want it to last. I?m really good about being motivated for a few days, and then just kind of slowly give up (usually when the weekend comes). I think that the main reason that this happens is that I?ve always thought ?how could that little snack or dessert or extra few hundred calories really make a difference?? Well, I?m set to prove to myself that it does- and it will if I just stuck with it and stay consistent. I really hope I can do that. I really, really do.

Jackie includes daily menus for an entire month, including a ton of recipes. I initially thought that I might try to follow her menu plans to the letter, but that?s not really logical for me. It?s much easier for me (and much more economical) to eat the same thing for breakfast and lunch throughout the week. So, I?m adapting her menus to my own needs- but I?m still following her ratios of proteins/grains/vegetables, etc.

This is how yesterday went:

Pre-workout: 1/2 banana with peanut flour butter (2 T peanut flour + 1 T almond milk mixed to a paste)? This wasn?t really ?on the plan,? but I HAVE to eat something before I work out in the morning, so I usually just divide the banana I would have had for breakfast anyway

Workout: Ran through first half of Bodypump routine (warm-up through tricpes), taught 50 min Spinning class

Breakfast: 1/2 cup oats cooked with 1/2 banana, 1/4 c. egg whites + 1/2 T peanut butter

Snack: 1 5.3 oz container Siggi?s plain yogurt

Lunch: Salad w/mixed greens, tomato, cucumber, cabbage + balsamic vinegar mixed with 1/2 T light balsamic dressing; homemade chickpea burger; fuji apple

Snack: 3/4 c 1% no salt added cottage cheese + 2 T chopped almonds/peanuts

Dinner (Panera): You pick two: 1/2 Fuji apple chicken salad (without cheese and just a tiny bit of dressing), 1 cup black bean soup, 1 piece of mutligrain bread

This totaled to almost exactly 1500 calories (1505 to be exact), which is my daily target from My Fitness Pal.

When I got home, I was really tempted to reach for something sweet, but I didn?t. I brushed my teeth, changed, and got into bed.

And this is what?s going on today:

Breakfast: 2 (homemade) buckwheat protein muffins (100 calories each) + 1/2 c Siggi?s 0% plain Skyr, 1/4 c blueberries, a few banana slices, 2 T peanut flour butter

Snack: 3 celery stalks with 1 T Better N? Peanut butter, 1/2 T peanut butter

Lunch: Salad w/mixed greens, tomato, cucumber, cabbage, 2 T goat cheese + balsamic vinegar mixed with 1/2 T light balsamic dressing; homemade chickpea burger; orange

Pre-workout: 1/2 banana

Workout: other half of Bodypump (Biceps-abs), 30-45 min Spinning (or some other form of cardio intervals)

Post-workout:(something I thought up in my head and don?t know if it will work out?) 1/2 c cottage cheese mixed with 1 egg and 1 egg white + 1 T coconut flour, vanilla stevia + cinnnamon baked into a ?pancake?

Dinner: Grilled albacore tuna stead with mango/red onion salsa, 1/4 c (dry) quinoa, mixed roasted veggies

? and? nothing else- except my cup of green tea.

So that?s the plan! I have to be honest here- the fact that I?m attending the Blend retreat in May is a big motivator for me. I even taped up a photo of Janetha?s killer abs (even though mine will?never look like that) onto my fridge as a reminder of this. I would really love to drop a size or two before I go to the retreat- considering most of the attendees look pretty ripped. I think that having something to work towards can really help keep me motivated.

The big key for me in finding success in this program is also planning. I find that I do most of my mindless eating because I?m so hungry by the time that I get home, and have no idea what to eat. I?m trying to plan out my entire next day the night before, so that I can just stick to it. Easy, right?

Wish me luck!

Have you ever read a book (or has there been some other factor) that?s motivated you to make changes in your life? What are your tips for staying motivated?

Fitness Starts in the Kitchen | Bon Secours Physical Therapy ...

As a fitness instructor, this is the time of year I dread. The mid-part of February when so many people give up going to the gym.

I think I know what happens. Or really, what doesn?t happen: instant weight-loss.

If you joined the gym this New Year and have been working out consistently, I have to ask you something: Did you remember that fitness starts in the kitchen?

It?s not an easy thing to talk about. Nobody likes change, especially when it comes to their food. But if you really want your time on the?treadmill and the hours you spend lifting weights to mean something, you have to think about what you eat. Exercise and eating nutritious meals work wonders for weight-loss when you do them concurrently.

Personally, I think motivating myself to the gym for a heart-pumping cardio workout is a lot easier than saying no to the chocolate chip cookies cooling on my kitchen counter. (They?re a treat for the kids.)

When I talk to people at the gym where I work, I realize that most of them just don?t know what they should be eating. That?s why it?s so important to learn about?nutrition and seek advice from a professional who?s qualified to give it, not ?- ahem ? a magazine that promises amazing abs in 14 days.

Learn Some Email Marketing Techniques To Make Your Online ...

All the techniques with internet marketing are available to anyone who chooses to use them, but it is interesting that they do not all use them with the same degree of proficiency.

Tons of people get involved with motivational quotes of the day, and you can analyze that very quickly and see what we are talking about. We will also contend that just about any person can rise far above where they are today if they just get good feedback and then work hard to improve.

It all begins with awareness about your self and what you do in your business, and that awareness can actually cause you to implement positive changes for the better. As you put any kind of ad campaign together, you will not always think about the various knowledge areas you are using.

Your ability and willingness to test all you do in business is one thing that will give you leverage.

Internet marketers have always emphasized on the importance of email marketing. It was immediately apparent that all they needed to do was get a list of addresses and then they could make money through that list for many years. Read the following email marketing tips that will boost your income more than ever.

Shocking as it may be, there are some email marketers who, unwisely, do not provide any links or means for unsubscribing or opting out from their list.

Perhaps they erroneously believe that providing an unsubscribe link will reduce their list size. It?s common sense and knowledge that if an email marketer only sends great content that helps people with their problems, then most people will want to stay and not leave. What they may not realize, also, is that an unsub link has to be included in each email - at least that?s the way it is in the US. There also cannot be any funny games about it, when they want to unsubscribe they should immediately been taken to a page to do so. One approach that some marketers use is the double opt-in because they think only those who are serious will subscribe. Never try to alter your email marketing campaign, as you risk losing customers. If you?re planning to run a newsletter/ezine or just want to send out regular tips to your list, make sure you have everything consistent, the look, the feel and the way you write your content. You will be implanting yourself in the back of your prospect?s minds, and thus they?ll always be primed to buy. Over enough time, your prospects will begin to welcome your emails as helpful. What that shows is that you really care that you?re there to help them, and that will generate loads more sales and a greater business.

Your email content must be considered useful and relevant to your readers. The reason is some email clients such as MS Outlook or Thunderbird have a preview pane. You have to make sure you don?t let go of any opportunity to increase the open rate of your emails. So just remember it?s all important from the subject line to your opening lines.

If you do it right, then email marketing can be your best and most profitable aspect of your online business. But at the same time it can be very hectic and difficult if you don?t know what you?re doing. It?s always a solid idea to further your learning on a subject, but you can take our tips with you because they?ll help you. No matter what you do - use an autoresponder service.

Are you working 11 hours a day? How depressing!

Researchers in Finland studied more than 2,000 white-collar workers over five years. The results were depressing. WBBH's Nick Ciletti reports.

By msnbc.com staff report

People who worked more than 11 hours a day are more were more than twice as likely to be depressed than their co-workers who put in an 8-hour day.

"There has to be different outlets of enjoyment in a person's life," said Mabel Lopez, a clinical psychologist.

Obama touts manufacturing at Wisconsin plant (AP)

MILWAUKEE ? President Barack Obama called Wednesday for tax cuts for American manufacturers and higher taxes for companies that move overseas, pressing what he hopes will be a winning campaign issue.

Appearing at a Milwaukee padlock plant, Obama said the U.S. must do everything it can to make it more attractive for American businesses to stay put and grow here home, and "one place to start is with our tax code."

The president visited Master Lock, a manufacturer that has brought jobs back to the United States. Reprising ideas from his State of the Union address, Obama asked Congress to approve tax system changes right away, including a minimum tax on multinational companies so that American firms can't skirt taxes by moving jobs and profits overseas. He also pushed for tax breaks for businesses that move into communities that have been hurt by factories leaving town.

"Don't wait. Do it now. Get it done," Obama shouted, his jacket removed and shirtsleeves rolled up, as he stood in front of a pile of stacked orange metal boxes, including one stamped "Made in the USA."

Obama stopped in politically important Wisconsin en route to a three-day West Coast fundraising swing. The president won Wisconsin by 14 points in 2008 but is expected to face a more difficult challenge this year. He said he decided to visit Master Lock "because this company has been making the most of a huge opportunity that exists right now to bring jobs and manufacturing back to the United States of America." And he called on other businesses to follow its lead and take advantage of rising costs overseas and growing productivity at home.

Master Lock brought back 100 jobs to the U.S. from China in response to higher labor and logistical costs in Asia.

Pointing to a rebound in manufacturing and pushing U.S. businesses to extend it, the president said: "Ask yourself what you can do to bring jobs back to your country, and your country will do everything we can to help you succeed."

The president made his economic pitch as Congress was poised to advance a key component of the jobs agenda he unveiled last September. Lawmakers from both parties were praising an emerging deal Wednesday on extending a payroll tax cut through the end of the year and renewing jobless benefits for the long-term unemployed. They hoped to send the measure to Obama within days.

The extension would be a win for Obama, who has said the cut in the Social Security payroll tax ? amounting to about $40 per paycheck for the average worker ? is vital to keeping the economy on the right path.

"I'm glad to see that Congress seems to be on the way of making progress," Obama said. "It will make a real difference in the lives of millions of people, and as soon as Congress sends me that extension of tax cuts and unemployment insurance to my desk, I will sign it right away."

Obama has repeatedly talked up the nation's manufacturing base as an engine of growth and a sign of a recovering economy. He has urged companies to promote "insourcing," promising new tax incentives for businesses that bring jobs to the U.S. instead of shipping them overseas and eliminating tax breaks for companies that outsource jobs.

The manufacturing sector was hard-hit for more than a decade. Manufacturers shed 5.8 million jobs from 1999 to 2009 as many companies shifted jobs overseas to take advantage of lower costs and many plants were modernized and automated, allowing firms to do more with fewer workers.

But the sector has shown more vitality in recent months, bolstering Obama's case. Manufacturers added 50,000 jobs in January, the most in a year, and added 237,000 jobs in 2011, the largest annual boost since 1997. Of the 3.2 million jobs added by the economy since February 2010, about 400,000 are in manufacturing.

Obama may face new challenges in Wisconsin after Republicans captured nearly every statewide office two years ago and the president's standing declined in parts of the Midwest. Obama's visit coincided with the one-year anniversary of the first widespread protests against proposals from Republican Gov. Scott Walker to effectively end collective bargaining rights for most public workers.

Walker, who greeted Obama at the airport, had been scheduled to join him for the event at Master Lock but decided at the last minute not to attend. Walker's spokesman, Cullen Werwie, said the governor was recovering from the flu and had to cancel his plans to go to the event.

The governor has been targeted for a recall election that could come in the spring or summer and has sought to define the outcome as a bellwether of how Obama will fare in Wisconsin next fall. Walker has said a win would deliver a "devastating blow" to Obama's re-election campaign.

But despite the political undertones Obama got a friendly tarmac welcome Wednesday from Walker, who presented him with a Milwaukee Brewers' jersey that bore the number 1 and Obama's name.

The two smiled and shook hands and Walker took a diplomatic tone in comments to a pool reporter at the airport: "Today's the president's day. I'm appreciative he's in Wisconsin, appreciative he's focused on manufacturing. We'll leave politics for another day."

The scene stood in stark contrast to Obama's tarmac moment with Arizona's Republican governor, Jan. Brewer, last month.

Most of Obama's trip will be devoted to fundraising. The president is holding eight fundraisers for his re-election campaign in the Los Angeles area, San Francisco and Seattle.

After departing Milwaukee, Obama was to attend two fundraisers in Los Angeles. The first is an outdoor fundraising reception at the home of soap opera producer Bradley Bell and his wife, Colleen, featuring a performance by the rock band the Foo Fighters. The campaign expects 1,000 supporters to attend, with tickets starting at $250.

Obama is also attending a dinner at Bell's home co-hosted by actor Will Ferrell and his wife, Viveca Paulin. Eighty people are expected to attend the dinner, with tickets costing $35,800. The fundraising will benefit the Obama Victory Fund, a joint fundraising committee for Obama's campaign and the Democratic National Committee.

Prolonged fructose intake not linked to rise in blood pressure, study suggests

ScienceDaily (Feb. 13, 2012) ? Eating fructose over an extended period of time does not lead to an increase in blood pressure, according to researchers at St. Michael's Hospital.

A new study has found that despite previous research showing blood pressure rose in humans immediately after they consumed fructose, there is no evidence fructose increases blood pressure when it has been eaten for more than seven days.

In fact, researchers led by Drs. David Jenkins and John Sievenpiper observed a significant decrease in diastolic blood pressure -- the measure of blood pressure when the heart is relaxed between contractions- in people who had eaten fructose for an extended period of time.

"A lot of health concerns have been raised about fructose being a dietary risk factor for hypertension, which can lead to stroke, cardiovascular disease, renal disease and death," said Vanessa Ha, a Master of Nutritional Sciences student and the lead author of the paper. "However, we wanted to determine whether fructose itself raised blood pressure, or if the apparent harm attributed to fructose was simply because people are eating too many calories."

For example, we know that people are consuming more soft drinks than ever, but is it the fructose, the extra calories, or possible other factors that are adding to their illnesses, she said.

The study looked at the effect of all sources of fructose, including natural and crystalline. Fruits are the primary source of naturally occurring fructose, and the fructose molecule found in fruits and vegetables is the same fructose found in high-fructose corn syrup. Crystalline fructose is a processed form which has added water and trace minerals.

In the systematic review and meta-analysis, Ha and colleagues pooled the results of 13 controlled feeding trials which investigated the effects of fructose on blood pressure in people who had ingested fructose for more than seven days.

The 352 participants included in their analysis ate an average of 78.5g of fructose every day for about four weeks. The U.S. average is an estimated 49g per day.

The paper is published in a recent edition of Hypertension, a journal of the American Heart Association.

Essential Small Business Accounting Practices | Article Hub

Accounting is an vital affair function regardless of the size and nature of the affair. By having accounting books and records accurately maintained, a affair will be able to determine how much profit it earned earlier and also the current financial health of the affair. The accounting books need to be right and they shouldn?t be based on assumptions or influenced by bias. The subsequent is a quick look at vital small affair accounting practices.

Accounts receivable is the balance of all the cash that?s presently owed to the affair from its customers. There are many purchasers who do not make immediate payments on their buys and promise to pay the quantity due at a certain future time. These kinds of buyers are referred to as debtors. During the buy, the seller issues an invoice and provides the customer a statement showing the total sum owed by the customer. The seller should keep a watchful eye on the total quantity owed as well as the period allowed for payment. In the event the buyer goes beyond the chose time period, then the seller will have to initiate some action.

Accounts payable is the opposite of accounts receivable and it?s all money that is to be paid by the affair to its creditors or lenders. The lease of the building, loans, taxes, salaries, all come under the accounts payable tab. There are some suppliers who place forward discounts to customers when they make the payment on time or prior to the specified date. A affair must pay attention to its accounts payable to make sure that it is able to use the discounts and also keep tabs of how much money goes out of the affair and at what point of time.

Order entry is the extension of accounts payable and accounts receivable. If a company makes the payment it owes, or when it receives the cash it?s owed, then the company would need to make an entry in its book of records. As always, the accountant will need to make sure of correctness while building these entries.

Inventory control is another element of small affair accounting and it?s one of the most vital areas. With excellent inventory management, a company wouldn?t have to deal with scenarios where it needs to forgo purchasers because of unavailability of stock. The affair will also be able to know just how much money it has tied up in its inventory as commodities.

To make sure that the affair operates smoothly, ordering inventory on time is essential. Payroll maintenance, cost accounting, and management accounting are a few of the additional elements associated with small affair accounting. Correctly maintained accounts will help with the growth and smooth functioning of the company.

EU probes Samsung, Germany blocks its tablets (AP)

BRUSSELS ? Samsung took a double-hit in its battle against archrival Apple on Tuesday, when the European Union announced it would investigate whether it was illegally trying to hinder competitors and Germany blocked sales of some of its tablet computers.

Samsung Electronics and Apple Inc. are engaged in a strategic war over patents in many countries across the world as they try to draw market share away from each other.

The EU's antitrust watchdog thinks the South Korean company may be overstepping the bounds and launched a formal investigation into whether Samsung is using law suits over key patents on 3G wireless technology to hinder competitors ? including Apple.

The European Commission, which is acting as the EU's antitrust enforcer, said it suspected Samsung of not giving other companies fair access to patents it holds on standardized 3G technology for mobile devices ? despite committing to do so in 1998.

A spokeswoman for the Commission said the probe also affected tablets such as Apple's newest iPad, which uses standardized wireless 3G technology.

The Commission said that Samsung last year sought legal injunctions against other device makers in several EU states, alleging patent infringement.

Under EU patent rules, a company that hold patents for standardized products are required to license them out indiscriminately at a fair price.

If Samsung is found guilty of unfairly restraining competition, it can be fined up to 10 percent of annual revenue related to the investigation.

"Samsung now has to think carefully about how it wants to deal with (the probe)," said Florian Mueller, a patent analyst who has been closely following the battle between Samsung and Apple.

In the EU, Samsung has sued Apple in Germany, France, Italy, the U.K., the Netherlands and Spain. It also has legal proceedings against its competitor in the U.S., South Korea, Japan and Australia, Mueller said. However, Mueller said, Samsung may now be inclined to withdraw its lawsuits against Apple following news of the European investigation.

The battle between the two companies began in April, when Cupertino, California-based Apple sued Samsung in the United States, alleging the product design, user interface and packaging of Samsung's Galaxy devices "slavishly copy" the iPhone and iPad.

Samsung ? the global No. 1 in TVs and No. 2 in smartphones by sales ? responded by filing its own lawsuits that accused Apple of patent infringement of its wireless telecommunications technology.

A spokesman said the European Commission launched its probe after its own investigation of the market, rather than reacting to complaints from Samsung's competitors. However, the Commission last year sent antitrust questionnaires to both Apple and Samsung.

The spokesman added that similar probes could also be launched against other companies strategically using patent suits to stop competitors from selling similar devices.

Nam Ki-yung, a spokesman at Samsung Electronics in South Korea, said his company was looking at details of the news on the probe but had no immediate comments.

EU antitrust probes don't have a deadline and the Commission stressed that its investigation does not mean Samsung did indeed breach the bloc's competition rules. Samsung now gets the chance to respond to the Commission's concerns, as will other market participants.

Also Tuesday, in a separate case, an appeals court in Germany ruled in favor of Apple, saying Samsung could not sell its Galaxy Tab 10.1 nor the Galaxy Tab 8.9 in the country because they too closely resembled the iPad2, in violation of unfair competition laws.

"Samsung wrongly used the enormous reputation and prestige of the iPad," Duesseldorf state court Presiding Judge Wilhelm Berneke wrote in his ruling.

Samsung's successor tablet, the Galaxy Tab 10.1 N, was not affected by the ruling, and the company said that while the decision was disappointing, it was largely irrelevant.

"Today's ruling is of little factual relevance due to the new model Galaxy Tab 10.1 N, and ... the decision therefore is of no indicative value with respect to other legal proceedings involving the Galaxy Tab 10.1 N," Samsung said in an email to The Associated Press.

"Samsung will continue to take all appropriate measures, including legal action, to ensure continued consumer access to our innovative products."

Mueller said the German court ruling won't have a commercial impact on the South Korean company, since it has already been selling a new model of the Galaxy tablet since November.

"The defeat in Germany is more of a symbolical nature," said Mueller, whose clients include Apple competitor Microsoft.

The probe and victory in the German court for Apple come after the California company has met with several setbacks recently in its fight with Samsung.

Most recently, a Dutch court ruled on Jan. 24 that Samsung's Galaxy Tab tablet was not a copy of Apple's iPad, and that it could continue to be sold in the Netherlands. That came on the heels of a December decision in Sydney, where the High Court dismissed Apple's appeal and said Samsung was free to sell its Galaxy tablet computers in Australia.

Robert Teitelman: Whatever Happened to Occupy Wall Street?

Gone but not forgotten. Occupy Wall Street has disappeared from Zuccotti Park, save for occasional gatherings of shivering souls watched over by yellow-jacketed police, but it lingers on the edge of consciousness, in the now embedded clich? "we are the 99%" and, apparently in Davos, where all things go to warm their hands on the gas-fed embers of 1% capitalism. Morgan Stanley's Stephen Roach lays out in today's Financial Times a final session at Davos that allowed a branch of the local Occupy movement to do their thing. As Roach himself says, "Friday's Open Forum, in an effort to take the debate from the glitterati to the real people" featured the topic "remodeling capitalism" and was a "chance to open this debate to the seething masses." Note a few assumptions here. First, glitterati are not real people, which may well be true -- I wouldn't know. Second, the "so-called Occupy Community" represented "the seething masses." This, of course, is the argument made by the Occupy community, embodied in the 99% slogan. But based on their numbers, on polls and on anecdotal evidence, they are a small segment of the overall population at large. Lastly, why do masses always seethe?

Roach's description of this affair sounds like something out of the '60s. The affair begins in chaos, with Occupy "agitators" stationed throughout the room leading chants. The panel itself is an m?lange of various points of view. Roach, as a Wall Street representative, is hissed. An hour-long discussion ensues. Roach comes to accept "a reasonable suggestion" on the need to balance growth and stability. And just before he escapes in the night, "Maria," an Occupy representative, offers her views: "The aim of Occupy is to think for yourself. We don't focus on solutions. We want to change the process of finding solutions."

That sentiment jives with what we know about the thrust of OWS at Zuccotti Park. It also sums up the challenges of the movement. Yes, it has achieved a certain amount of celebrity; and its sloganeering has been effective. But what has it become? OWS's notion of creating a political transformation -- "We want to change the process of finding solutions" -- is rooted in place, in physical proximity, like Athenian democracy. This is paradoxical, given its expert use of social media for drawing crowds, and self-limiting. Without a physical space, an encampment, where general assemblies can be held and the interminable process of achieving democratic consensus reached, this is just another protest movement, albeit one with a sense of humor and a talent for slick slogans. This explains, I think, OWS's continuing attempts to find a new home, first in the empty lot owned by Trinity Church, then this weekend, in the cozy confines of Washington Square Park, with New York University around it like a very expensive muffler. There's something bittersweet about this, with its efforts to replicate Zuccotti without turning the public against them. As The Wall Street Journal writes: "Organizers said they hoped demonstrations like Sunday would improve the movement's public image, a sentiment that comes just a day after protesters in Oakland clashed with police and more than 300 people were arrested."

Gordon Crovitz in the WSJ also took up the plight of OWS but from a more critical perspective. He argues that OWS violated property rights and as long as municipalities and the police enforce those rights, the movement will fade. He may be right; he may be wrong. (Crovitz blames "liberal city politicians" in New York for letting the movement take root. It's a sign of how conservative the Republican Party has become that the moderate Bloomberg administration could be called "liberal.") Crovitz argues that OWS was essentially an "AstroTurf" movement, started by AdBusters, and thus, in a sense, lacking authenticity, legitimacy, roots in anything real. Like Roach's "real people" we now get to tangle with what's real or not. Is the Tea Party, which also has AstroTurf roots, real? Well, its votes in the 2010 elections were certainly real; and Sarah Palin sold a ton of books to someone real. And one could say that OWS, whether its genesis was AstroTurf or not, has had "real" consequence. President Obama is taking a decidedly more aggressive populist stand than before OWS. And even the Republican primary battle between Romney and Gingrich features issues like inequality, private equity and Wall Street articulated by OWS -- or by interpreters of OWS in the punditocracy. In fact, it doesn't matter. Nearly every political movement that makes an impact began with an organizer. The notion of a true grassroots movement is mostly a myth (historically, many of them sprang from the political parties). That said AstroTurf movements couldn't sustain themselves unless troops from the grass roots sign up for duty. The Tea Party achieved that; for a few months, the Occupy movements did as well. The real question, which returns us to the importance of "place," is whether it will be self-sustaining come the spring.

That's an open question. The emphasis on fundamental political transformation is stirring but, again, decidedly self-limiting. The decision to press specific issues smacks of politics as usual. Who wants to wrestle with the kind of hard economic issues Roach laid out in his Davos remarks: inequality, global income disparities and growth? Besides, the greatest threat to OWS is that it becomes familiar and boring: toward the end of the Zuccotti phase, that, plus a certain loss of patience in a group that was increasingly viewed as parasitic, began to limit the tolerance of the surrounding community toward the affair. The real challenge for the OWS core group is to devise a fresh and inspiring new shtick -- a new Zuccotti or effective slogans that paper over the underlying incoherence of the movement -- knowing full well that to resort to public spaces is now probably off the table. To get anything done, to get any attention (to "occupy" the media), OWS needs to mobilize large numbers, and that will depend in part upon the economic situation with its large numbers of unemployed and indebted young folks. How they'll pull that off will be fascinating to watch. One thing to keep in mind: The one solution to the fear of becoming boring and irrelevant is to become more aggressive, to confront the authorities more brazenly. That, however, has nothing to do with democratic transformation and consensus and will lose the still-accepting nature of the larger community. Meanwhile, media and public attention will be increasingly focused on a presidential election.

OWS is, in a sense, running for office just as hard as Gingrich, Romney and Obama. But the task is far more difficult.
